HB 204 (BR 1026) - C. Siler, D. Horlander, C. Miller, K. Upchurch

     AN ACT relating to concessions in state parks.
     Create new sections of KRS Chapter 148 to provide definitions; require the secretary of the Tourism Development Cabinet to promulgate regulations for the evaluation of applications and the issuance of master agreements to concessionaires in state parks; require that each master agreement have a term of ten years except for extraordinary circumstances, provide for an authorization fee to be paid to the Commonwealth, provide for annual performance evaluations, and contain specific requirements that protect the health and welfare of the public; require the secretary of the Tourism Development Cabinet to promulgate regulations pertaining to annual performance evaluations; specify conditions under which a master agreement may be suspended or revoked; state that the issuance of a master agreement shall not adversely affect any right or obligation that exists under previous agreements, contracts, or other authorizations.

     HCS - Delete original provisions; direct the Interim Joint Committee on Economic Development and Tourism to study the process of evaluating applicants and issuing master agreements for state park concession activities; report to the Legislative Research Commission by December 1, 2002.
