HB 371 (BR 1612) - R. Webb, J. Hoover, P. Childers, P. Clark, J. Crenshaw, C. Hoffman, D. Horlander, R. Palumbo
AN ACT relating to controlled substances.
Amend KRS 218A.180 to require a pharmacist to indicate on the prescription the method of identifying the presenter; amend KRS 218A.202 to specify that an officer authorized to receive data on controlled substances be engaged in a "criminal" investigation involving violation of a drug law.
HB 371 - AMENDMENTS
HCS - Amend to require a pharmacist or pharmacist employee to identify a person hand delivering or taking possession of a controlled substance; add the option of requiring 2 forms of identification, one of which is government issued and add that a third party taking physical possession of the prescription is also required to present identification; add requirement to verify the identity of the person receiving the prescription when a pharmacist or employee delivers a prescription; exempt from provisions Schedule V drugs that do not require a prescription and agents of health care facilities signing for prescriptions; delete requirement for officers to be involved in a "criminal" investigation and reinstate the requirement to be involved in a "specific" investigation in order to request data from the Cabinet for Health Services; delete limitation to investigation of "drug" laws; reinstate that the investigation involve a "designated person"; add that the investigation may be of an identifiable trend in a geographic area.
SCS - Amend to delete thumbprint requirement to include requirement that controlled substances be dispensed by a pharmacist licensed in Kentucky to require a record of signatures to be kept for two years; and exempt controlled substances dispensed by a health care facility for use therein from coverage of bill.
SFA (1, J. Denton) - In amendment of KRS 218A.180, require that out-of-state pharmacies that dispense drugs into Kentucky have a Kentucky licensed pharmacist in charge; specify verification and delivery requirements; simplify in-state verification requirements; specify that out-of-state pharmacy that delivers drugs in Kentucky report to KASPER system; require the Interim Joint Committee on Health and Welfare to study drug diversion and make recommendations for new statutes and other recommendations by October 1, 2002.
SFA (2, J. Denton) - In amendment of KRS 218A.180 provide exemption for person who legally purchases a controlled substance out of state and brings it back to Kentucky in original container.
