HB 376/FN (BR 1600) - M. Marzian
AN ACT relating to the Kentucky Board of Nursing.
Create new sections of KRS 314 to provide that if a nurse seeking relicensure sends a check that is dishonored by a bank and fails to pay the check and fee within 30 days of a written notice from the board, the board may immediately suspend the license until the check and fees are paid; require the board to mail the written notice to the address on record with the board; permit the nurse to request an emergency hearing on the temporary suspension of the license; provide that upon notice from the Cabinet for Families and Children that the nurse has violated KRS 205.712 the board is required to suspend an active license or deny an application for licensure and the board's order constitutes disciplinary action; provide that the suspension shall continue until the Cabinet for Families and Children notifies the board that the individual is no longer in violation of KRS 205.712; provide that the nurse is not entitled to a hearing on the suspension; require that all reinstatement requirements be met before the license can be reinstated; amend KRS 314.026 to delete the Nursing Incentive Scholarship Fund Committee and require the board to make awards from the nursing incentive scholarship fund; establish a Nursing Incentive Scholarship Fund Grant Review Committee to make recommendations to the board and specify membership; amend KRS 314.085 to require a licensee to submit to a mental health, chemical dependency, or physical evaluation by a practitioner designated by the board; amend KRS 314.089 to specify that an order of immediate, temporary suspension of a license remains in effect until reconsidered or superseded by the board; amend KRS 314.171 to rename the impaired nurses committee the alternative to discipline program and make technical corrections and permit the program to order examination or evaluation of a potential applicant to the program; repeal KRS 164.2893.
HB 376 - AMENDMENTS
HCS/FN - Retain original provisions, except provide that the Board of Nursing may include in the alternative to discipline program those nurses or applicants who have practice competency deficits.
HFA (1, M. Marzian) - Retain original provisions except clarify that a nurse shall not have a right of appeal of a license suspended due to violation of child support orders administered by the Cabinet for Families and Children under 42 U.S.C. 651 et seq.
SCS/FN - Retain original provisions except make one technical correction which changes reference from licensed nurse to licensed practical nurse.
SFA (1, D. Seum) - Retain original provisions except delete requirements regarding suspension of nursing license when a nurse or applicant is in violation of child support orders.
SFA (2, D. Seum) - Retain original provisions except permit rather than require the board to suspend or revoke, or deny licensure to a nurse reported to be in violation of child support orders.
