HB 521/LM (BR 1915) - R. Damron

     AN ACT relating to cemeteries.
     Amend KRS 381.231 to define "burial ground"; and amend KRS 381.697 to require owners of burial grounds to protect them from damage, desecration, and destruction as prescribed.

HB 521 - AMENDMENTS


     HFA (1, S. Lee) - Exempt cemetery owners if property is damaged, destroyed, or desecrated by criminal action as prescribed.

     HFA (2/P, R. Damron) - Attach the provisions of HB 58 to HB 521.

     SCS/LM - Retain the original provisions as passed by the House; create a new section of KRS Chapter 307, relating to cemeteries, to require the operator of any cemetery that has improperly interred a body or cremated remains to disinter and properly reinter the remains at the cemetery's expense; require the cemetery, prior to disinterment and proper reinterment of the body or cremated remains, to notify the next of kin of the deceased and, if requested, the owner of the burial space, regarding the improper interment and the agreed upon date of the disinterment and proper reinterment; amend KRS 525.105 to change the penalty for desecration of venerated objects in the first degree from a Class D felony to a Class C felony; amend KRS 525.115 to provide that all offenses of the crime of violating graves shall be Class D felonies.

     SCA (1/Title, A. Robinson) - Make title amendment.

     SFA (2, E. Tori) - Amend KRS 381.697 to add language requiring private burial ground owners to construct cemetery protection structures only if the property is in a county with a cemetery board and if the cemetery board provides compensation to the property owner for supplies, labor, and other expenses associated with such construction.

     SFA (3, E. Scorsone) - Add a new section to define abuse of a corpse as the acceptance of remuneration for the preparation of a corpse for burial or cremation and a deliberate failure to do so.

     SFA (4, E. Scorsone) - Amend HB 521/SCS to include as abuse of a corpse the failure to prepare, bury, or cremate a corpse in deliberate violation of a contract negotiated.
