     AN ACT relating to medical practice.
     Amend KRS 311.530 for technical correction; amend KRS 311.535 for technical correction; amend KRS 311.545 to delete references to the State Board of Health; amend KRS 311.550 to exclude family remedies, first aid, or medical assistance rendered in the absence of a licensed practitioner, and the use of automatic external defibrillators from the definition of the "practice of medicine or osteopathy," and add and delete other definitions; amend KRS 311.560 to exclude physicians with sports entities from the requirements for licensure and delete references to physician assistants; amend KRS 311.565 for technical correction; permit board to obtain criminal history information; require licensee to reimburse board the cost of administrative proceedings when a violation is found; amend KRS 311.571 to permit a fellowship training license and specify requirements for license; require board to give reasonable notice and opportunity to be heard when denying licensure; permit a visiting professor license and specify requirements for license; amend KRS 311.572 to permit provisional permit to practice medicine and make technical corrections; amend KRS 311.580 to make technical corrections and references; amend KRS 311.586 to make technical corrections; amend KRS 311.591 to require board to have two panels of seven members each and prohibit president from being a permanent member of either panel but permit president to serve on a panel; permit an inquiry panel to issue a letter of concern as a public document when there is insufficient evidence of a violation but there is evidence of a practice or activity that requires modification; create a new section of KRS Chapter 311 to permit a hearing panel to impose probation not to exceed five years; permit a hearing upon receipt of information that a term or condition of probation has been violated; require a finding from the hearing; require personal service to the physician on a motion to revoke probation; require the hearing to be limited to whether a violation of probation has occurred; require an order on completion of the hearing; permit hearsay as a basis of the board's findings in a hearing on an emergency order; amend KRS 311.595 to specify mental or physical illness or deterioration, or extended absence from the practice of medicine as grounds for denial of licensure; amend KRS 311.597 to specify unprofessional conduct relating to electronic communication for prescribing or dispensing drugs; create a new section of KRS Chapter 311 to specify requirements for resumption of practice after an absence of at least two years; amend KRS 311.605 to delete requirement that county boards of health report names and addresses of each person believed to be engaged in the practice of medicine; permit the board to restrain an individual not licensed or practicing in violation of a restriction or suspension; permit a petition to be filed in Jefferson County or other counties with venue; specify terms of the injunction; amend KRS 311.616 to permit board to promulgate administrative regulations; provide operational expenses for an impaired physicians program; amend KRS 311.618 to make technical corrections and references; amend KRS 311.619 to make technical corrections and references; require the program to report any suspected violation of professional conduct; create a new section of KRS Chapter 311 to define terms relating to physician assistants and supervising physicians; create a new section of KRS Chapter 311 to require board to promulgate administrative regulations relating to certification and regulation of physician assistants; require board to establish a physician assistant advisory committee; specify membership; exclude students and physician assistants employed by the federal government from certification requirements; create a new section KRS Chapter 311 to specify education and examination requirements for certification and recertification as a physician assistant; create a new section of KRS Chapter 311 to permit additional physician assistants and for supervising physicians and emergency permits for physician assistants in medical emergencies; create a new section of KRS Chapter 311 to specify conditions for denial or revocation of certification of a physician assistant; create a new section of KRS Chapter 311 to require board approval to act as a supervising physician and specify requirements for application for approval; specify the number of physician assistants permitted to practice under supervision; create a new section of KRS Chapter 311 to specify duties of a supervising physician; create a new section of KRS Chapter 311 to specify scope of practice of a physician assistant; create a new section of KRS Chapter 311 to specify requirements regarding practice location of a physician assistant; create a new section of KRS Chapter 311 to specify requirements for a physician assistant practicing as an anesthesiology assistant; amend KRS 217.015 to conform; repeal KRS 311.567 and 311.618.

     HFA (1, R. Damron) - Retain original provisions and make technical corrections; create a new section of KRS Chapter 311 to permit the board to issue an emergency order and conduct a hearing when a physician assistant has violated an agreed order or disciplinary order; permit a supervising physician to continue supervision and a physician assistant to continue to practice if they were in practice prior to the effective date of this Act and require the supervising physician to submit the required application by October 15, 2002; specify that a physician may supervise a maximum of 4 physician assistants but no more than 2 at one time.

     HFA (2, R. Damron) - Retain original provisions and make technical corrections; create a new section of KRS Chapter 311 to permit the board to issue an emergency order and conduct a hearing when a physician assistant has violated an agreed order or disciplinary order; specify that a new application to the board is required before a physician assistant performs services or procedures beyond those identified in the initial application; permit a supervising physician to continue supervision and a physician assistant to continue to practice if they were in practice prior to the effective date of this Act and require the supervising physician to submit the required application by October 15, 2002; specify that a physician may supervise a maximum of 4 physician assistants but no more than 2 at one time.

     HFA (3, R. Damron) - Retain original provisions and make technical corrections, add definition of "complaint"; require disciplinary proceedings to be conducted in accordance with KRS Chapter 13B; create a new section KRS Chapter 311 to permit the board to issue an emergency order when a physician assistant has violated an agreed order or disciplinary order and conduct a hearing; specify that a supplemental application to the board is required before a physician assistant performs services or procedures beyond those identified in the initial application and permit an initial and supplemental application to be submitted at the same time, permit a supervising physician to continue supervision and a physician assistant to continue to practice if they were in practice prior to the effective date of this Act and require the supervising physician to submit the initial or supplemental application by October 15, 2002; specify that a physician may supervise a maximum of 4 physician assistants but no more than 2 at one time.
