AN ACT relating to hospitalization for psychiatric care.
     Amend KRS 386.093 to permit a durable power of attorney for a disabled principal to provide consent for admittance to a general hospital for psychiatric care not to exceed 14 days; require the durable power of attorney to provide notice to the court with 48 hours of admittance and permit court to appoint an attorney and conduct a hearing; the hearing, if conducted, is required to be held within 3 days of notice of hospital admittance; require a court order to extend the stay beyond 14 days; amend KRS 387.660 to specify that a guardian may consent for mental health treatment for the ward; permit a guardian to provide consent for admittance to a general hospital for psychiatric care not to exceed 14 days; require the durable power of attorney to provide notice to the court with 48 hours of admittance and permit the court to appoint an attorney and conduct a hearing; the hearing, if conducted, is required to be held within 3 days of notice of hospital admittance; require a court order to extend the stay beyond 14 days; require approval of the secretary for the Cabinet for Families and Children for state-appointed guardians to admit wards.
