AN ACT relating to water quality certifications.
Amend KRS 224.16-070, relating to the Natural Resources and Environmental Protection Cabinet, approving coal mine mitigation measures when a stream is impacted by the mine; specify the physical mitigation measures which shall be acceptable to the cabinet; allow payments by the coal mine operator into a fund in lieu of physical mitigation; create a trust and agency account to receive payments; direct the cabinet to appoint a committee to advise the cabinet on use of the fund; direct the cabinet to manage the fund; require the money to be used in a coal producing county; direct the cabinet to work toward reforming the water quality certification process.
HB 798 - AMENDMENTS
HCA (1, P. Childers) - Delete original provisions; declare that the U.S. Army Corps of Engineers, the U.S. EPA, the U.S. Department of Fish and Wildlife are encouraged, and the Kentucky Department of Fish and Wildlife Resources is directed, to consider as acceptable compensatory mitigation measures for unavoidable impacts under Sections 404 and 401 of the federal Clean Water Act, any combination of certain measures deemed adequate by those agencies to compensate for adverse impacts of proposed surface coal mines.
