HB 842 (BR 2728) - R. Palumbo, M. Weaver

     AN ACT relating to the Kentucky Commission on Elder Abuse.
     Repeal and reenact KRS 209.005 to create the Kentucky Commission on Elder Abuse; name members, duties, responsibilities, and recommendations to be made by the commission; require election of co-chairs; require a majority vote of members for a quorum; require open and accessible meetings and adoption of by-laws; require an annual report to be submitted to the General Assembly, the Governor's Office, the secretary for families and children, the secretary for health services, the Office of the Attorney General, the secretary of the Justice Cabinet, and the secretary of the Public Protection and Regulation Cabinet; amend KRS 209.030 to make technical correction.

HB 842 - AMENDMENTS


     HCS - Retain the original provisions; amend penalty section to make a "person" rather than a "caretaker" subject to penalties for abuse or neglect of an adult; make conforming amendment deleting a penalty that is no longer necessary due to language changing references from "caretaker" to "person."

     HFA (1/Title, M. Weaver) - Make title amendment.

     SFA (1, J. Denton) - Create a new section of KRS 205.510 to 205.645 to require adult day health care programs to provide services only during the posted hours of operation.

     SFA (2/Title, J. Denton) - Make title amendment.

     SFA (3, L. Casebier) - Add one representative each from the Kentucky Association of Health Care Facilities, the Kentucky Association of Health Services for the Aging, the Kentucky Home Health Association, and the Kentucky Hospital Association to the commission.

     SFA (4, J. Denton) - Create a new section of KRS Chapter 436 to provide that a person who violates the provisions of Section 1 of 2002 House Bill 138/GA for pecuniary gain shall be civilly liable in an amount not less than $50,000 and not greater than double the amount equal to gross gain, if that amount is greater than $50,000.

     SFA (5, J. Denton) - Create a new section of KRS Chapter 436 to provide that nothing in Section 1 of 2002 House Bill 138/GA shall be construed to restrict areas of scientific research or treatment not specifically prohibited by federal regulation, including research in the use of nuclear transfer or other cloning techniques to produce molecules, DNA, cells other than human embryos, tissues, organs, plants, or animals other than humans.
