AN ACT relating to employment contracts of deputy sheriffs
Amend KRS 70.030 to allow sheriffs to require employment contracts, to allow sheriffs to set the term of service to recover training and equipment costs, to require law enforcement agencies that employ a deputy sheriff before the completion of the employment contract to reimburse the sheriff for the cost of training and equipping the deputy.
SB 100 - AMENDMENTS
SFA (1, E. Scorsone) - Amend Section 1(2) to provide that if a deputy sheriff takes a job with another law enforcement agency within 3 years of employment and participation in the KLEFF training program, the sheriff's office may recover the actual, out of pocket training costs from the law enforcement agency that hires the deputy; define cost of training and equipping the deputy.
SFA (2, E. Scorsone) - Delete provisions of original bill and create a new section of KRS Chapter 70 to authorize a 3-year employment contract with newly-hired peace officers who participate in the KLEFFP fund; provide that law enforcement agency be reimbursed for the cost of training if the peace officer leaves the law enforcement agency that initially hired the officer within the 3 year period; set out costs of training and provide for pro rata reimbursement; provide that reimbursement amount be reduced by the cost of the training provided by the Dept. of Criminal Justice Training; provide for reimbursement of state law enforcement agency if the peace officer is hired by a city or other local law enforcement agency under same terms and conditions.
SFA (3/Title, E. Harris) - Make title amendment.
HFA (1, J. Gray) - Amend SB 100/GA to allow deputy sheriffs or peace officers to purchase their contracts and free themselves from a period of service requirement; allow state peace officers to reimburse their agency allowing employment outside the agency before three years of service.
HFA (2, M. Marzian) - Amend language to specify that an officer who is under contract to an agency for three (3) years or less and takes employment with another agency may be required to repay his or her training costs on a prorated basis; allow a law enforcement agency that hires a trained officer who is under contract to buy out the remaining portion of the officer's contract; require that if the hiring agency does not choose to buy out the officer's contract that the hiring agency may deduct funds from the officer's net pay for the training costs as established in the subsection; detail what "training costs" include; include provisions for a peace officer who has been employed by a state law enforcement agency for three (3) years or less and accepts employment as a peace officer with a city or local law enforcement agency.
HFA (3, S. Riggs) - Retain original provisions; change length of employment contract from "no longer than three (3) years" to "no longer than two (2) years."
