SB 150 (BR 2006) - T. Buford
AN ACT relating to the practice of dentistry.
Create new sections of KRS Chapter 313 to establish requirements by which a dental hygienist may practice without the direct physical supervision of the supervising dentist; permit the Board of Dentistry to promulgate an administrative regulation that sets forth the duties to be performed by dental assistants and other qualified personnel, including duties relating to polishing of clinical crowns; permit a licensed dentist to delegate the administration of block and infiltration anesthesia and nitrous oxide analgesia under the direct supervision of the dentist under specified circumstances; amend KRS 313.310 to conform.
SB 150 - AMENDMENTS
SCS - Retain original provisions of the bill except delete "may" and insert "shall" throughout the provisions in Section 2 relating to dental assistants to include the board's promulgation of administrative regulations, approval of instructors and courses of study, guidelines for service provision, and definition for scope of practice that includes coronal polishing; include services dental assistants shall not perform; amend KRS 313.310 to delete language regarding numbers of full-time dental hygienists in a licensed dentist's employ.
HCS - Retain original provisions; and create new sections of KRS Chapter 313 to require licensing of persons engaging in the practice of denturitry; define the practice; prohibit one from engaging in the practice if he or she is not licensed and has not registered with the Board of Dentistry or does not meet minimum competencies; require board to establish licensing process within 6 months, otherwise the Kentucky Denturists Association will provide a list of names of qualified denturists to board, which shall then issue licenses, rather than allowing for Association to issue licenses; establish fines and jail time for persons practicing denturitry without a license; permit board to institute legal action to obtain injunction against persons practicing without a license; provide for reciprocal licensing; provide for grandfather clause; permit a person who has practiced as a denturist for 2 years to be licensed upon submitting 3 affidavits from former patients, 3 affidavits from persons who have received denturitry services within last year, and an affidavit showing proof of membership in the Association for at least 2 years; require board to institute disciplinary action against persons practicing without a license; and require board to issue regulations within 6 months to implement Act.
