SB 25/LM/CI (BR 208) - D. Kelly, J. Denton, V. McGaha, A. Robinson, R. Roeding, D. Seum, E. Tori

     AN ACT relating to trafficking in, possession of, or use of drugs or controlled substances used to facilitate or used in furtherance of the commission of sexual offenses.
     Amend KRS 218A.1412 relating to trafficking in a controlled substance in a the first degree to add flunitrazepam (rohypnol); amend KRS 218A.1415 relating to possession of a controlled substance in the first degree to add flunitrazepam (rohypnol); amend KRS 510.050, KRS 510.080, and KRS 510.110 to include provisions relating to administration of controlled substances or legend drugs for purposes of committing various sex crimes.

     SFA (1, D. Kelly) - Delete reference to reason why defendant or another person rendered the victim incapacitated in amendment of KRS 510.050 relating to rape in the second degree; delete reference to reason why defendant or another person rendered the victim incapacitated in amendment of KRS 510.080 relating to sodomy in the second degree; delete reference to reason why defendant or another person rendered the victim incapacitated in amendment of KRS 510.110 relating to sexual abuse in the first degree; insert amendment of KRS 510.010 relating to definitions for the chapter to delete controlled substances and legend drugs from definition of mentally incapacitated and to reinsert controlled substances and legend drugs in the definition of physically helpless; insert amendment of KRS 510.060 relating to rape in the third degree to delete reference to being mentally incapacitated; insert amendment of KRS 510.090 relating to sodomy in the third degree to delete reference to being mentally incapacitated; insert amendment of KRS 510.120 relating to sexual abuse in the second degree to delete reference to being mentally incapacitated.

     HCS/FN/LM/CI - Make trafficking in the drug GBH a Class C felony for a first offense and a Class B felony for a second or subsequent offense; make possession of GBH a Class D felony for a first offense and a Class C felony for a second or subsequent offense.

     HFA (1/P, R. Wilkey) - Section 2 from SB 119 to SB 25, relating to expanding the crime of incest.
