AN ACT relating to venue in civil actions arising from Internet business transactions.
Create a new section of KRS Chapter 452 which provides that legal actions arising from the sale of goods or services by a Kentucky buyer through the use of the Internet may be maintained against a seller using the general venue laws of the state, except as otherwise provided by this Act; authorize internet sellers to appoint an agent for service of process for actions relating to internet business transactions; require that legal action be brought only in the county where the agent for service of process is located if the seller includes relevant information on the Web site; require that an agent for service of process be authorized to do business in the Commonwealth and can include an individual, domestic or foreign corporation, a limited liability company or limited partnership, or limited liability partnership; provide that appointment of an agent for service of process shall not constitute consent to jurisdiction of courts of the Commonwealth.
