AN ACT relating to crimes against disabled adults and elder persons and declaring an emergency.
Establish new KRS Chapter 535, relating to crimes against disabled adults and elder persons, and create new sections thereof to define terms and establish first through fourth degree crimes of abuse, neglect, and exploitation; create a new section of KRS Chapter 455 to provide speedy trial provisions in the prosecution of Kentucky Penal Code offenses where the victim is of the age of sixty-five or older; amend KRS 387.510 to specify that law enforcement agency is an interested party; amend 387.530 to provide that a law enforcement agent investigating abuse, neglect, or exploitation allegation may file a disability petition for alleged victim; amend KRS 387.770 to provide that law enforcement agent, county attorney, or Commonwealth's attorney need only request access to confidential disability records from the clerk of the court; amend KRS 209.150, 209.990, and 508.090 to conform; make technical amendments to KRS 209.010, 209.020, 209.030, 210.045, and 610.127; name act "The 2003 Kentucky Crimes Against Disabled Adults and Elder Persons Act;" and declare EMERGENCY.
