HB 159 (BR 839) - J. Gooch
AN ACT relating to utilities.
Amend KRS 224.50-760 to define petcoke and to exempt utility wastes incurred when firing petcoke singularly or blended with coal from the definition of special wastes; require that utility wastes produced from petcoke or from cofiring petcoke with coal be disposed of in a solid waste facility meeting the technical requirements and performance standards of a contained landfill; amend KRS 278.010 to define petcoke; amend KRS 278.183 to prohibit recovery of current capital or operations and maintenance costs incurred at any point when the utilities' generating facility burned petcoke or burned petcoke blended with coal.
HB 159 - AMENDMENTS
HCS - Delete Sections 1 to 3; create non codified section of KRS Chapter 224 directing the Natural Resources and Environmental Protection Cabinet, with assistance from the Public Service Commission, to study petcoke usage in the Commonwealth; require a report of study finding by December 15, 2003.
