AN ACT relating to traffic regulations.
Create a new section of KRS Chapter 189, relating to traffic regulations, to define "bill of lading", "building materials", "home", and "state road"; authorize vehicles hauling building materials to a home to travel on any state road without a permit and without being subject to a fine, if the weight of the vehicle is within its registration and axle weight limits; allow an operator to travel the most direct route to the home delivery site provided any road traveled upon cannot be further than 15 miles from a state road that is classified to carry the registered weight of the vehicle; provide that if a vehicle is traveling on a road classified as "A" the vehicle or its load cannot exceed 96 inches; if a vehicle or its load exceeds 96 inches and wants to travel on a A road, the operator must obtain an overdimensional permit from the Transportation Cabinet; prohibit all vehicles hauling building materials from exceeding posted bridge width and weight limits; require a vehicle that exceeds bridge limits to obtain an overdimensional or overweight permit from the Transportation Cabinet; amend KRS 189.221 and KRS 189.230 to conform.
HB 255 - AMENDMENTS
HCS - Retain the provisions of the original bill; add a new Section 3 to amend KRS 189.222 to provide a limited exemption to transport agriculture products without a permit; add a new Section 5 to amend KRS 189.221 to conform.
SCS/FN/LM - Retain original provisions with the following additions: add forest products to the list of agricultural products which are allowed to carry 80,000 pounds to market; amend KRS 138.470 to exempt all charter buses and those motor carriers and farm trucks registered in excess of 44,000 pounds from motor vehicle usage tax; amend KRS 139.480 to exempt repair and replacement parts for all charter buses and those motor carriers and farm trucks registered in excess of 44,000 pounds from sales tax; amend KRS 186.040 to place additional $10 county clerk fee on registration of vehicles in excess of 44,000 pounds; amend KRS 235.085 to conform; name Act the "Trucking Economic Viability Act of 2003"; make use tax exemption effective October 1, 2003; make sales tax exemption effective January 1, 2004; make increased clerk's fee effective July 1, 2003.
