AN ACT relating to revenue and taxation.
Amend and repeal various provisions of KRS Chapter 139 to conform Kentucky's law to the required provisions of the Streamlined Sales and Use Tax Agreement.
HB 293 - AMENDMENTS
HCS/FN - Retain original provisions; provide that Act takes effect July 1, 2004; delete Section 32 in its entirety.
HCA (1, H. Moberly) - Exempt baked goods prepared by the seller and provided without eating utensils.
SCA (1, D. Kelly) - Amend KRS 138.470 to exempt motor vehicles with a gross weight of 44,001 lbs. or greater from the motor vehicle usage tax; amend KRS 139.480 to exempt repair and replacement parts for motor vehicles with a gross weight of 44,001 lbs. or greater from the sales tax; amend KRS 186.040 to provide that the county clerks receive a $20 fee for each registration of a motor vehicle with a gross weight of 44,001 lbs. or greater and increase the registration fees to $125 for motor vehicles with a gross weight of 44,001 lbs. but less than 73,281 and $150 for motor vehicles with a gross weight of 73,281 or greater; motor vehicle sales and usage tax provisions apply October 1, 2003, and the increase in registration fees applies July 1, 2003.
SFA (1, D. Kelly) - Amend KRS 138.470 to exempt motor vehicles with a gross weight of 44,001 lbs. or more from the motor vehicle usage tax; amend KRS 139.480 to exempt repair and replacement parts for motor vehicles used in interstate commerce with a gross weight of 44,001 lbs or more from the sales tax; amend KRS 186.040 to provide that the county clerks receive a $20 fee for each registration of a motor vehicle with a gross weight of 44,001 lbs. or more, and increase the registration fees to $125 for motor vehicles over 44,001 lbs. but under 73,281 lbs. and $150 for motor vehicles over 73,281 lbs.; make motor vehicle sales and use tax provisions apply October 1, 2003, and the increase in registration fees apply July 1, 2003.
CCR - Cannot agree and request appointment of a Free Conference Committee.
FCCR - Retain provisions of the bill as it passed the house; create a new section of KRS Chapter 189 to define terms; authorize vehicles hauling building materials to a home to travel on any state road without a permit and without being fined if the weight of the vehicle is within registration and axle weight limits; amend KRS 189.221 to provide limited exemption for the transport of agricultural products; amend KRS 138.470 to exempt motor vehicles with a registered gross weight of over 44,001 pounds and farm trucks with a registered weight of over 44,001 pounds from the motor vehicle usage tax; amend KRS 139.480 to exempt repair and replacement parts purchased for the direct operation of a motor vehicle, including any towed unit, used exclusively in interstate commerce for the conveyance of property or passengers for hire, provided the motor vehicle is licensed for use on the highway and has a gross vehicle weight including any towed unit of 44,001 or greater; provide a fee of $20 for the county clerk upon the registration of all vehicles with a gross vehicle weight of 44,001 or greater; provide for an increase in registration fees for vehicles with gross weight of 44,001 or greater; make technical corrections; amend the title.
