     AN ACT relating to retail marketing practices.
     Create a new section of KRS Chapter 365 to permit a cigarette retailer and a cigarette manufacturer to enter into and participate in promotional or consumer discount agreements or programs under which a retailer merchandises, advertises, stocks, or displays the manufacturer's product; limit the scope of the agreements to forbid the manufacturer from conditioning the agreement of the retailer's conduct or actions relating to the manufacturer's or another manufacturer's products, the size or location of the space the retailer allots to a manufacturer's or another manufacturer's products, or the percentage of space the retailer allots to the manufacturer's or another manufacturer's products; prohibit agreements that bar the retailer from participating in another manufacturer's programs or restrict the prices a retailer can charge on another manufacturer's products; establish a cause of action for violations on the part of the manufacturer.
