HB 523 (BR 1568) - G. Stumbo

     AN ACT relating to budgets.
     Create a new section of KRS Chapter 7 to establish the Committee on Budget Preparation and Management as a subcommittee of the Legislative Research Commission; designate the co-chairs of the Senate and House standing Committees on Appropriations and Revenue as co-chairs of the committee; require the President of the Senate and the Speaker of the House to each appoint three additional members, all of whom are members of a standing Committee on Appropriations and Revenue and at least one of whom, from each chamber, is a member of the minority party; direct the Legislative Research Commission to provide staff services o the committee; list duties of the committee relating to budget preparation instructions and plans, budget requests, and implementation of enacted budgets; require the committee to regular report to the standing and interim joint Committees on Appropriations and Revenue; permit the committee or its co-chairs acting jointly to conduct hearings and on-site visits to review programs and budget information; direct the executive and judicial branches, on request of the committee, to provide the most current available revenue, budget, and program information, in the format requested, within thirty days; require budget units to provide support for the committee and staff to access and interpret the information; permit the committee by majority vote of its membership to initiate investigations, audits, inspections, evaluations and studies relating to its duties, subject to the Legislative Research Commission's authority to cancel the initiation or completion of the committee-authorized project; authorize the Legislative Research Commission to delegate to the committee its power to administer oaths, subpoena witnesses and records, and otherwise compel the giving of evidence; direct executive and judicial branch agencies, officers, and employees to assist the committee and its staff by providing agency access and information as requested by a majority vote of the committee members; deem any officer or employee who fails to provide information or impedes the committee's performance guilty of a class A misdemeanor; declare the Open Records law's exemption of preliminary drafts and recommendations from disclosure inapplicable to public records requested by the committee.
