AN ACT relating to juries.
Amend KRS 29A.100, relating to postponement of service or excusing of juror, to give a prospective juror a right to postpone his or her initial appearance for jury service 1 time; amend KRS 29A.130, relating to limitation on jury service within a twenty-four 24 month period, to provide that a person shall not serve on more than 1 petit jury in any 24 month period; amend KRS 29A.160, relating to employer's duties, to order an employer not to require, request, or permit an employee to use annual, vacation, or sick leave for time spent responding to a summons for jury service, time spent serving as a juror, or for time spent attending court for prospective jury service, and to provide that an employee may bring a civil action for an employer's violation; create a new section of KRS Chapter 29A to provide for automatic postponement of jury service for a juror of an employer with 5 or fewer full-time employees if another employee of that employer is summoned for jury service during the same period; create a new section of KRS Chapter 29A to require the Supreme Court to promulgate rules to establish a lengthy trial fund, to be used to provide full wage replacement or wage supplementation to jurors who serve on petit juries in civil litigation; to provide that the lengthy trial fund is to be funded by fees collected by each trial court from each attorney who files a civil case; direct the administrator of the fund to use the fees to pay full wage replacement or wage supplementation to jurors; provide process for jurors to submit a request for payment from the lengthy trial fund; provide list of attorneys and causes of action that are exempt from payment of the lengthy trial fund fee.
