AN ACT relating to the purchase of prescription drugs and declaring an emergency.
Create a new section of KRS Chapter 11 to authorize the Governor to enter into agreements with other states or multistate or regional consortia for the purpose of purchasing prescription drugs for use with various state and local health insurance programs, including but not limited to health services, jail and corrections health programs, workers' compensation, and programs in colleges and universities; require program participation to be cost-effective and to include protocols for patient safety; permit the Commonwealth to negotiate supplemental rebates with pharmaceutical manufacturers to offset expenditures of these programs; require the Governor to establish a Pharmacy and Therapeutics Advisory Committee to assist with the operation of the rebate program; permit the Governor to establish a preferred drug formulary for drugs from manufacturers that have entered into supplemental rebates; create a new section of KRS 205.510 to 205.645 to define "supplemental rebate"; specify other program benefits that may be included in addition to cash; authorize the Cabinet for Health Services to establish a preferred drug formulary for drugs from manufacturers that have entered into negotiated supplemental rebates with the cabinet; permit the cabinet to enter into a contract with an outside agency to conduct negotiations for supplemental rebates; EMERGENCY.
