HB 63 (BR 323) - R. Crimm, M. Weaver
AN ACT relating to motor vehicle insurance.
Amend KRS 304.39-080 to prohibit a person from operating a motor vehicle unless there is security on the motor vehicle in full force and effect, as required by Subtitle 39 of KRS Chapter 304; provide that a person who operates a motor vehicle that is not covered by the required security shall be subject to the penalties in KRS 304.99-060; amend KRS 304.99-060 to provide that an operator of a motor vehicle without the required security shall be fined not less than $500 dollars nor more than $1000 or sentenced to not more than 90 days, or both; require for the second and each subsequent offense the revocation of the operator's license and a sentence of not more than 180 days, or a fine of not less than $1,000 nor more than $2,500, or both; provide that if the operator is also the owner of the motor vehicle, the person shall be subject to separate penalties as owner and operator.
HB 63 - AMENDMENTS
HCS - Delete original provisions of the Act; amend KRS 304.39-080 to subject the owner of an uninsured vehicle who permits another person to drive the vehicle to penalties; amend KRS 304.99-060 to delete operator from the provision; require as a penalty that the owner have proof of insurance for one year or until registration renewal; add as a penalty for the second and subsequent offenses that the registration be revoked and the license plates suspended for one year; require a receipt for payment of premium be provided along with proof of insurance if the first offense penalty is conditionally discharged, suspended, or otherwise reduced; amend KRS 186.570 to permit the Transportation Cabinet to deny or suspend an operator's license if the person is a habitual violator of the statute that mandates owners to have liability insurance coverage on their vehicles.
SCS/LM - Delete original provisions; amend KRS 304.39-080 to subject the owner of an uninsured vehicle who permits another person to drive the vehicle to penalties; amend KRS 304.99-060 to provide that a person who operates a motor vehicle without the required security shall be fined between $500 and $1000 and sentenced to not more than 90 days or both, and for a second and subsequent offense within a 5-year period shall have his operator's license revoked and may be sentenced to 180 days in jail or fined between $100 and $2500, or both; subject to both penalties if the owner and the operator who operate the motor vehicle without security are the same person; amend KRS 186.570 to permit the Transportation Cabinet to deny or suspend an operator's license if the person is a habitual violator of the statute that mandates owners to have liability insurance coverage on their vehicles.

Denton) - Amend KRS 205.560 to require Medicaid to use forms and guidelines established by the commissioner of insurance to assess the credentials of health care providers applying for participation in Medicaid; amend KRS 216B.155 to require health care facilities to use the application form and guidelines established by the commissioner of insurance to assess the credentials of persons applying for privileges; and amend KRS 314.17A-545 to require the commissioner of insurance to establish a uniform application form and guidelines for the evaluation and reevaluation of health care providers, including psychologists, who will be on a health benefit plan's list of participating providers.
