SB 154/LM (BR 1197) - R. Jones II

     AN ACT relating to crimes and punishments.
     Amend KRS 218A.1422, regarding possession of marijuana, to require confinement for thirty days in the county jail and a fine of five hundred dollars for the first offense; require court to order defendant, at defendant's cost, to receive a substance abuse assessment, complete treatment and rehabilitation, and pass random drug and alcohol testing; require court to impose original sentence if defendant fails to complete the requirements or fails the drug and alcohol test; require court to suspend original jail sentence if defendant successfully completes the requirements; require court to expunge record of defendant's conviction if defendant qualifies; specify new penalties for possession of marijuana, second offense and third and subsequent offenses; prohibit pretrial diversion for possession of marijuana offenses; amend KRS 218A.010 to conform; repeal KRS 218A.276, regarding treatment and rehabilitation for possessors of marijuana.
