     AN ACT relating to an insured's or claimant's right to choose a motor vehicle repair facility.
     Create a new section of Subtitle 12 of KRS Chapter 304 to direct that an insured or claimant has the right to choose any repair facility for the repair of a motor vehicle loss; prohibit an insurer from requiring that a motor vehicle be repaired at a specific repair facility; provide that if an insurer provides information about a repair facility the insurer must inform the insured or claimant of this right to choose; provide that if the insured or claimant elects to have the vehicle repaired at the repair facility of his or her choice the insurer is prohibited from limiting or discounting the reasonable repair costs based on charges that would have been incurred had the vehicle been repaired by the insurer's chosen repair facility; provide that if an insured or claimant selects a repair facility to repair the insured's or claimant's motor vehicle in which the insurer owns an interest in that repair facility, the adjuster for the motor vehicle cannot be employed by the repair facility or have any direct authority over that facility's recommendations or decisions relating to the repair of the insured's or claimant's motor vehicle; authorize the commissioner to suspend or revoke a license or certificate of authority for any violation of this Act and subjection any violation to the penalties in KRS 304.99-020.
