HB 182/FN/LM (BR 109) - S. Nunn

     AN ACT relating to automatic external defibrillators.
     Amend KRS 311.666 to define "physical fitness facility"; amend KRS 311.667 to require local emergency medical services system, communications, or dispatch to report each July 1 to the Kentucky Board of Emergency Medical Services on the location and type of AED in their communities; create a new section of KRS Chapter 311 to require each physical fitness facility to have at least one AED on the premises and at least one trained AED user on site at any time the facility is used, permit physical fitness facilities to arrange training with emergency medical services, the Kentucky Board of Emergency Medical Services, or local health departments; require the Cabinet for Health and Family Services to inspect a physical fitness facility upon a complaint that a facility does not have an AED; permit the Cabinet for Health and Family Services, with consultation by the Kentucky Board of Emergency Medical Services, to promulgate administrative regulations for more than one AED at a facility based on the type and size of the facility. coordination among facilities and local emergency medical services, and inspections following a complaint, and training requirements for physical fitness facility employees; create a new section of KRS Chapter 311 to specify penalties for failing to have an AED on the facility's premises as a written warning for the first offense, a fine of $1,500 for a second violation, and $2,000 for a third violation; specify procedures to impose a civil monetary penalty and require all fines collected to be deposited into the Cabinet's agency funds for use in administering the Act; amend KRS 311.667 to conform.

HB 182 - AMENDMENTS


     HCS/FN/LM - Retain original provisions except require AED manufacturer to report sales to the Kentucky Board of Emergency Medical Services and require the board to notify local EMS of locations of AEDs in their jurisdiction; delete requirement for inspections of facilities and fines for violations.

     HFA (1, S. Brinkman) - Retain provisions of the bill; add a new section to KRS 304.12 to prohibit insurers from denying coverage to an applicant or insured when the sole reason is for noncompliance with the provisions of this bill.

     HFA (2, S. Brinkman) - Retain provisions of the bill; add a new section amending KRS 311.668 to exempt any person or entity who is subject to and in compliance with the provisions of the bill from civil liability.

     HFA (3, S. Brinkman) - Retain the original provisions of the bill; add exemption from civil liability for consequences related to the use or nonuse of an AED that is located in a physical fitness facility; add a new section amending KRS 311.668 to exempt any person or entity who is subject to and in compliance with the provisions of the bill from civil liability.
