HB 221 (BR 376) - M. Marzian, J. Vincent

     AN ACT relating to the standby guardianship of minors.
     Create new sections of KRS Chapter 387 to permit a parent to designate a standby guardian and an alternate standby guardian for minor children to provide care in case of death or incapacity of the parent; permit a custodian, legal custodian, or legal guardian to appoint a standby guardian with the consent of another parent or adoptive parent if there is one; require signed consent of the standby guardian and the parent, legal custodian, or legal guardian in the presence of two witnesses; make provisions for designation of standby guardian before and after the triggering event occurs; permit the court to consider the preferences of minor children in the appointment of a standby guardian; establish a rebuttable presumption that the designated standby guardian is capable of serving as a guardian; permit approval of the designation without a hearing if the designator is the sole surviving parent; set requirements for the standby guardian's authority.

     HFA (1, J. Vincent) - Amend to provide that a court appointed guardianship or a testamentary guardianship is superior to one created under the bill; provide that notice of a petition be served on both parents; provide that bill's provisions do not apply to guardians, conservators, or other fiduciaries appointed by a court.
