AN ACT relating to The Kentucky Recreational Trail System.
Create new sections of KRS Chapter 148 to establish the Kentucky Multiple-use Recreational Trail Commission, to be attached to the Commerce Cabinet, and set forth responsibilities to develop and implement a multi-county demonstration trail system project, to be funded by counties interested in promoting trail development and managed for statewide and multi-state promotion and access; include existing state statutory requirements for ATVs which are ridden by children; require semiannual reports on access to multiple-use recreational trails on privately owned land in Kentucky to include recommendations for improvements; require the commission to sunset in two years and to recommend a transition plan for a long-term permanent state entity to plan, promote, fund, and manage multi-county recreational trails which are developed for multiple uses, including pedestrians, horses, motorized and nonmotorized vehicles, and are on privately owned land.
HB 233 - AMENDMENTS
HCS - Create the Kentucky Hatfield-McCoy Trail system, working with the statewide Kentucky Recreational Trails Authority, to establish a pilot project area limited to all-terrain vehicles (ATV) and off-road vehicles (ORV) in Eastern Kentucky. Require participating counties to donate funds for the trail system development and operation, establishing the Kentucky Hatfield-McCoy Trail Project Fund, enabling other methods of raising funds for the pilot project Hatfield-McCoy Trail System. Establish the Kentucky Hatfield-McCoy Trail Commission, as an on-going entity to develop and demonstrate the trail system as a pilot project, including representation from counties participating in the pilot project. Enable the Commission to proceed with trail development, set safety guidelines, requiring semi-annual reports to the Governor and the Legislative Research Commission including recommendations for lessons learned through operating the pilot project, not only for the Kentucky Hatfield-McCoy Trail system development, but also for the ongoing statewide work of the Kentucky Recreational Trails Authority. Enable the Kentucky Hatfield-McCoy Trail Commission to contract with private landowners to implement the trail system and to enter into interstate agreements with the West Virginia Hatfield-McCoy Trail authority.
