     AN ACT relating to informed consent in an individual private setting.
     Create a new section of KRS 311.250 to 311.379 to establish that anytime informed consent is required in an individual private setting, informed consent is only valid when a face-to-face meeting occurs with both parties in the same room.

HB 585 - AMENDMENTS


     HCS - Specify that if a statute uses the phrase "individual, private setting" to describe conditions for informed consent, then the informed consent offered is valid only if a physician or licensed nurse, physician assistant, or social worker to whom the responsibility has been delegated by the physician has a face-to-face meeting with the patient and both parties are in the same room.

     HFA (1, K. Stein) - Retain original provisions and amend KRS 212.345 to require informed consent for nontherapeutic sterilization to be obtained by a face-to-face meeting between the physician or others at least 24 hours prior to the procedure.

     HFA (2, K. Stein) - Replace all text with an amendment to KRS 311.725 to specify the conditions for informed consent as valid only if a physician or licensed nurse, physician assistant, or social worker to whom the responsibility has been delegated by the physician has a face-to-face meeting with the patient and both parties are in the same room.

     HFA (3, S. Nunn) - Retain original provision and add that informed consent may be obtained by using the telehealth network.

     HFA (4, M. Marzian) - Replace all text with HB 489 as introduced.

     HFA (5, M. Marzian) - Replace all text with HB 489, except permit an exception for rape and incest.

     HFA (6, S. Nunn) - Retain original provision and add that informed consent may be obtained by using the telehealth network.

     SCS/LM - Delete original provisions; replace with SB 125.

     SCA (1/Title, K. Stine) - Make title amendment.
