AN ACT relating to methamphetamine contamination.
Create a new section of subchapter 1 of KRS Chapter 224 to provide for standards and certification of cleanup of properties contaminated by clandestine methamphetamine production; provide for definitions; provide for statutory standards for cleanup, or alternative standards by administrative regulation; provide for the establishment through administrative regulation of standards for training and certification of contractors for cleanup work; provide for required notification prior to agreement to a lease or sale of contaminated property; provide for release of owner liability if property meets standards for cleanup; provide for notifications of state agencies of property contamination; provide for listing of contaminated properties and removal from list if cleaned up to standards; provide for authority to promulgate administrative regulations to effect provisions of the section and to determine requirements for contractor documentation.
HB 591 - AMENDMENTS
HCS/LM - Establish responsibilities of the Environmental and Public Protection Cabinet and the Cabinet for Health and Family Services; permit a local health department to attach methamphetamine-contaminated property until the property is cleaned up; make technical changes.
HFA (1, T. Pullin) - Make technical changes.
HFA (2, T. Pullin) - Clarify that a local health department shall rely on its KRS Chapter 212 powers to protect the public from health hazards posed by methamphetamine contamination.
