AN ACT relating to substances in the body.
Create a new section of KRS Chapter 72 to require coroners to report deaths that result from the presence of drugs or poisons in the body to the Vital Statistics Branch; create a new section of KRS Chapter 189A to require peace officers to cause the testing of blood, breath, or urine, or a combination thereof, of a person believed to be operating a motor vehicle when the vehicle is involved in an accident that results in death or serious physical injury to determine the presence and concentration of alcohol or any substance that may impair driving; impose penalty for refusal of testing.
HB 67 - AMENDMENTS
HCS/LM/CI - Establish a new section of KRS Chapter 72 to require the State Medical Examiner's Office to report the total number of deaths with the presence of any illegal drug in the body, the total number of deaths caused by illegal drugs, and when indicated by history or autopsy or both, the total number of deaths caused by inappropriate use of prescription drugs; require the report to identify the type of illegal drugs, and require report to be available on a monthly basis and include the county of residence of each decedent and no additional identifying information; amend KRS 189A.105 to specify that when a person is charged with violation of KRS 189A.010 and a fatal accident is involved, law enforcement is required to seek a search warrant for blood, breath, or urine testing if consent is not given; specify that if testing pursuant to warrant reveals the presence of alcohol or other impairing substances in the defendant, the defendant is required to make restitution to the state for the cost of testing.
HFA (1, B. Yonts) - Require the Division of Kentucky State Medical Examiners Office to submit an annual report to the secretary of the Justice Cabinet regarding the number of deaths in each county and the major categories or generic names of the drugs involved instead of requiring a monthly report of the number of deaths in each county related to illegal drugs or by overuse or inappropriate use of a legally prescribed drug.
