HB 68 (BR 249) - B. Yonts, R. Palumbo

     AN ACT relating to the donation of food.
     Amend KRS 217.127 to exempt the donation of apparently wholesome food by retail food establishments from regulation by the state; create a new section of KRS Chapter 217 to prohibit the regulation of the donation of apparently wholesome food by retail food establishments; and amend KRS 413.248 to provide civil and criminal immunity to retail food establishments that donate apparently wholesome food to a nonprofit organizations for distribution to the needy.

HB 68 - AMENDMENTS


     HCS - Retain original provisions, except delete new language relating to civil and criminal immunity of retail food establishments that donate wholesome food to a nonprofit organization for distribution to the needy; clarify that the civil and criminal immunity of a person who donates wholesome food to a nonprofit organization for distribution to the needy includes an individual, corporation, partnership, organization, association, or retail food establishment.

     HFA (1, B. Yonts) - Clarify that safe and apparently wholesome food donated by retail food establishments or any other entity regulated under KRS 217.127 shall not be subject to further inspections or regulations if the donated food has been inspected under the provisions of KRS 217.127.

     SCS - Retain original provisions; amend KRS 139.480 to exempt donated food by a retail food establishment from use tax.
