     AN ACT relating to jailers.
     Create new sections of KRS Chapter 71 establishing definitions; establish State Board of Jail Personnel Standards of Kentucky; set membership of board; establish procedures for filling board, terms of membership, vacancies, causes for removal, meetings, and oath, with no member to vote on any item with direct or indirect financial interest to member; establish method of selecting officers of board; set compensation of board members; set quorum of board; establish duties of board, seal, administrative regulations concerning examinations, record-keeping, annual report to Governor, employment of legal counsel; allow board to elect to offer differing examinations; require passage of examination to be a certified jailer or certified jail administrator; establish dates, locations and advertising of examinations; establish procedures for elections with only one candidate qualified; require board to hold records 12 months and make available to participants; establish the duties and compensation of a noncertified jailer; create new sections of KRS Chapter 441 requiring appointment of certified administrator within 90 days of election of noncertified jailer; establish qualifications for administrator; make administrator a policy-making employee of county for any merit purposes; receive compensation to be fixed by judge/executive in light of any relevant county policies; upon appointment, require jail administrator to assume all duties of a certified administrator; allow replacement of administrator upon election of certified jailer; require jailer-elect to be consulted in decision to replace; require jailer to assume duties of chief operating and administrative officer of jail upon assumption of office; allow administrator to be removed for cause; establish procedures for replacement of administrator removed for cause; amend KRS 64.5275 to allow only certified jailers to be subject to salary and training increments; allow noncertified jailers to receive training as court bailiffs; amend KRS 64.535 to limit salary requirements to certified jailers; amend KRS 67.170 to include certified jailers and administrators, allowing noncertified jailers to act as superintendents of public buildings; amend KRS 196.701 to make the appointee be a certified jailer; amend KRS 441.005 to include definitions of certified jailers and administrator; amend various KRS sections to conform; make section requiring certification EFFECTIVE JULY 15, 2007.
