SB 130 (BR 1399) - D. Kelly, K. Winters, B. Guthrie, V. McGaha, R. Roeding, K. Stine, G. Tapp, D. Thayer, J. Westwood

     AN ACT relating to educational assessment and accountability.
     Amend KRS 158.6453 to require that, beginning in 2008-2009, the assessment program under the Commonwealth Accountability Testing System (CATS) for high schools include the ACT examination in English, reading, mathematics, and science to be administered in grade 11, the WorkKeys assessments in reading for information, business writing, and applied mathematics, and any other component necessary to comply with the federal No Child Left Behind Act; establish that the Act examination and additional items in high school be used in lieu of a customized or commercially available norm-referenced test; establish the kinds of accommodations to be provided for students with disabilities taking the ACT; establish that the new portions of the high school assessment program shall be known as the "Kentucky Work and College Readiness Examination" or "Readiness Examination"; require the cost of the first administration of the Readiness Examination to be paid for by the Kentucky Department of Education; require individual reporting of student results on the Readiness Examination; require that student results on the Readiness Examination shall be recorded on a student's high school transcript; create a new section of KRS Chapter 158 to require a high school to offer a student who receives a low score on the ACT in English, reading, or mathematics the opportunity to participate in a remedial program; establish permissible components of the remedial program; require the Kentucky Department of Education, the Council on Postsecondary Education, and public universities to provide technical assistance to schools and school districts in the development of remediation programs; require a school district to pay for the cost of a second administration of the ACT, to be reimbursed by the Kentucky Department of Education if the student meets established achievement standards; establish that the cost of any subsequent administrations of the ACT shall be paid by the student; amend KRS 158.6455 to establish the 2008-2010 school years as the new baseline for high schools for measuring school improvement under the CATS assessment and accountability system.

SB 130 - AMENDMENTS


     SCS - Retain original provision of the bill, except amend KRS 158.6453 to establish that changes to the assessment program in middle and high school shall be implemented no later than the 2008-2009 school year; require the assessment program to include a high school readiness examination in the 8th grade and a college readiness examination in the 10th grade; require all students in the 11th grade to take the ACT; require the cost of the ACT be paid for by students who elect to have ACT scores forwarded to colleges; require the cost of the ACT be paid for by the Kentucky Department of Education for students electing not to have ACT scores forwarded to a college; require the WorkKeys assessment to be taken only by those students who choose not to have ACT scores forwarded to colleges; establish in the new section of KRS Chapter 158 that the high school readiness examination in the 8th grade shall be in lieu of a customized or commercially available norm-referenced test in middle school; change references to a high school "remediation" program to an "accelerated learning" program; require students with low scores on the high school readiness examination in the 8th grade or the college readiness examination in the 10th grade to have intervention strategies for accelerated learning incorporated into their learning plan; require the Kentucky Department of Education, rather than the school district, pay for a second administration of the ACT test; delete provisions requiring the establishment of a new baseline for the assessment system; require the Kentucky Department of Education to consult with the National Technical Advisory Panel for Assessment and Accountability for adjustments to the formula for the accountability index or the baseline required if substantive changes are made to the assessment and accountability system.

     SCA (1, K. Winters) - Make technical corrections.

     SFA (1, T. Shaughnessy) - Require the ACT and WorkKeys Assessments be taken by all students in the 11th grade; require the scores of the assessments to be added to the students' transcripts; require the Kentucky Department of Education to pay for the assessments.

     SFA (2, T. Shaughnessy) - Require an individual student report to parents for each fifth grade student summarizing the student's readiness in reading and mathematics for middle school based on the student's fourth grade state assessment results; require a plan for accelerated learning for any student with identified deficiencies.

     SFA (3, T. Shaughnessy) - Require an individual student report to parents for each fifth-grade student summarizing the student's readiness in reading and mathematics based on the student's fourth-grade state assessment results; require the school's fifth-grade staff to develop a plan for accelerated learning for any student with identified deficiencies.

     HCS/FN - Retain original provisions, except require all 11th grade students to take the ACT test at the expense of the Kentucky Department of Education; require students who score high on readiness tests to be counseled to enroll in accelerated or advanced placement courses; allow students in grades 10, 11, or 12 to take the WorkKeys assessments with the initial cost to be paid by the Kentucky Department of Education; require the issuance of Kentucky employability certificates to students meeting the WorkKeys threshold established by the Cabinet for Workforce Development; require the Kentucky Department of Education to seek input from the Office of Education Accountability, the School Curriculum, Assessment, and Accountability Council, and the National Technical Advisory Panel on Assessment and Accountability regarding reducing the number of questions on the Commonwealth Accountability Testing System if it is determined that open-response or multiple-choice items in the assessment program provide direct measures of the standards of the core content for assessment; delete specific components of accelerated learning that are to be developed by the school district.

     HCA (1, H. Moberly Jr) - Change dates for new assessment requirements from "2008-2009" to "2007-2008."

     HFA (1, H. Moberly Jr) - Require the Kentucky Department of Education to select the high school readiness exam to be given to students in grade 8, to select either the PLAN or PSAT college readiness exam to be given to students in grade 10, and to select the ACT or the SAT college admissions and placement test to be given to students in grade 11.

     HFA (2, F. Rasche) - Make technical corrections.

     HFA (3, M. Marzian) - Attach provisions of HB 270/GA to SB 130/HCS.

     HFA (4/Title, M. Marzian) - Make title amendment.

     HFA (5, R. Nelson) - Direct the Legislative Research Commission to study the cost of textbooks, supplies, and instructional supplements at the elementary, secondary, and postsecondary levels.
