SB 134 (BR 900) - D. Kelly
AN ACT relating to reorganization.
Amend KRS 11.505 to rename various divisions and offices within the Commonwealth Office of Technology (COT); transfer the Division of Printing Services from the Office of Administrative Services (FAC) to COT; amend KRS 11.512 to transfer the Office of the 911 Coordinator from COT to the Office of Homeland Security; amend KRS 11.515 to change the name of the Geographic Information Advisory Council to the Kentucky Geospatial Board; make changes in the membership of the board; repeal KRS 11.550 and reenact as a new section of KRS Chapter 194A to transfer the Telehealth Board from COT to the Cabinet for Health and Family Services; amend KRS 12.023 to attach the Office of Homeland Security to the Office of the Governor; create a new section of KRS Chapter 42 to establish a Utility Savings Council to evaluate energy costs throughout state government; establish the duties and membership of the council; amend KRS 42.016 to attach the Utility Savings Council to the Office of the Secretary of the FAC; amend KRS 42.0171 to transfer the Division of Fleet Management from the Transportation Cabinet to the FAC's Office of Administrative Services; amend KRS 56.450 to add the executive director of the Office of the Controller to the membership of the State Property and Buildings Commission; amend KRS 56.861 to add the executive director of the Office of the Controller to the Kentucky Asset/Liability Commission; amend KRS 65.7623 to attach the Commercial Mobile Radio Service Emergency Telecommunications Board to the Office of Homeland Security, rather than to COT, for administrative purposes; amend KRS 131.020 to establish the Division of Special Investigations within the Department of Revenue; give instructions to the reviser of statutes; amend KRS 11.507, 11.517, 42.0172, 42.650, 65.7621, 174.020, 205.559, 216.265, 304.17A-138, and 342.315 to conform; confirm Executive Orders 2005-560, 2005-562, and 2005-1254 to the extent these orders are not otherwise confirmed or superseded by this Act.
SB 134 - AMENDMENTS
HCS - Retain original provisions; amend KRS 11.507 to add a provision directing that nothing in that section give COT the right to release or provide access to an agency's data that is confidential under attorney-client evidentiary privileges or the Kentucky Rules of Professional Conduct, or to an agency's projects and systems that are related to confidential or privileged data; create a new section of KRS Chapter 11 to direct the Secretary of Finance and Administration to review the information technology infrastructure of each executive branch agency and consolidate operational control under the COT when it is found to be in the best interests of the Commonwealth; exempt the Transportation Cabinet; amend and repeal various KRS sections to abolish the following administrative bodies: the Central State Hospital Recovery Authority, County Officials Compensation Board, Kentucky Savings Bond Authority, Kentucky Pollution Abatement and Water Resources Finance Authority, Water Resource Development Commission, Governor's Advisory Committee on Intergovernmental Relations, Procurement Advisory Council, Red Fox Tri-County Cooperative Corporation, and Agricultural Diversification and Development Council; amend KRS 151.710 to increase the total membership of the Kentucky River Authority from twelve to thirteen; permit a member to continue to serve and vote until his or her successor is appointed and qualified; require a quorum to be seven instead of six; amend KRS 224A.030 and 224A.300 to make technical corrections and conforming amendments.
HFA (1, S. Nunn) - Remove the provision in Section 23 which removes the Transportation Cabinet from the technology infrastructure streamline provision.
HFA (2, J. Vincent) - Amend KRS 174.125 to rename the Kentucky Bicycle and Bikeway Commission to the Kentucky Bicycle and Pedestrian Byways Commission; clarify the duties of the commission; allow the commission to file an amicus curiae brief in the cases before the state or federal courts.
HFA (3/P, A. Simpson) - Attach the provisions of HB 437 GA.
