AN ACT relating to state property.
Amend KRS 56.010 and 413.150 to prohibit acquiring title to state property by adverse possession; amend KRS 148.066 and 148.991 to prohibit the interference with property managed by the Department of Parks and provide for penalties.

SCS - Amend KRS 56.010 and 413.150 to prohibit acquiring title to state property by adverse possession, prescription, or any other related legal theory; amend KRS 148.066 and 148.991 to prohibit the interference with property managed by the Department of Parks and provide for penalties.

SFA (1, T. Jensen) - Delete amendment of KRS 148.066 relating to offenses on park property and KRS 148.991 relating to penalties for offenses on park property; renumber section to conform.
HFA (1, B. Yonts) - Specify in Section 1 of the bill that the provisions shall not apply to any claim for recovery of an interest in real property against the state if the action to enforce the claim is filed on or before 12 months after the effective date.
HFA (2, W. Hall) - Create the Kentucky Hatfield-McCoy Trail system, working with the statewide Kentucky Recreational Trails Authority, to establish a pilot project area limited to all-terrain vehicles (ATV) and off-road vehicles (ORV) in Eastern Kentucky. Require participating counties to donate funds for the trail system development and operation, establishing the Kentucky Hatfield-McCoy Trail Project Fund, enabling other methods of raising funds for the pilot project Hatfield-McCoy Trail System. Establish the Kentucky Hatfield-McCoy Trail Commission, as an on-going entity to develop and demonstrate the trail system as a pilot project, including representation from counties participating in the pilot project. Enable the Commission to proceed with trail development, set safety guidelines, requiring semi-annual reports to the Governor and the Legislative Research Commission including recommendations for lessons learned through operating the pilot project, not only for the Kentucky Hatfield-McCoy Trail system development, but also for the ongoing statewide work of the Kentucky Recreational Trails Authority. Enable the Kentucky Hatfield-McCoy Trail Commission to contract with private landowners to implement the trail system and to enter into interstate agreements with the West Virginia Hatfield-McCoy Trail authority.
HFA (3/Title, W. Hall) - Make title amendment.
HFA (4, W. Hall) - Create a new section of KRS Chapter 382; create a public-private recreational land use agreement; authorize the public to utilize the owner's land for recreational purposes; specify that the government party shall be responsible for maintenance; specify that the owner shall not be liable for damages or injuries; allow for the termination of the agreement.
HFA (5, T. Pullin) - Amend to establish an intrastate natural gas pipeline trust fund to receive a portion of the natural gas severance tax attributable to natural gas severed or processed from new wells completed on or after January 1, 2007; define terms; create a new section of KRS Chapter 143A to deposit a portion of new severance tax receipts to the trust fund; provide that deposit shall occur following the transfers to the local government economic assistance trust fund; EFFECTIVE January 1, 2007
