     AN ACT relating to current and former members of the United States Armed Forces and their families and declaring an emergency.
     Create new sections of KRS Chapter 36 to establish the military family assistance trust fund; provide that the trust fund consists of moneys collected from grants, contributions, and appropriations; create the Military Family Assistance Trust Fund Board to oversee the administration of the fund; direct the adjutant general to administer the trust fund; establish eligibility requirements for United States Armed Forces families, including families of National Guard and Reserve on federal active duty; require the Department of Military Affairs to establish a Mission: Welcome Home Program for members of the Kentucky National Guard returning from federal active duty; amend KRS 198A.040 to require the Kentucky Housing Corporation to provide assistance, including the awarding of grants, to member of the National Guard and Reserve and their families during federal active duty; amend KRS 18A.190 to permit a state employee who is a spouse of a member of the United States Armed Forces, including a member of the National Guard or Reserve on federal active duty, one day off, with pay, from work when the member is deployed and one day off from work when the member returns from deployment; amend KRS 159.035 to permit an elementary or secondary school student an excused absence when that student's parent is a member of the United States Armed Forces, including a member of the National Guard or Reserve on federal active duty, and is deployed and when that student's parent returns from deployment; amend KRS 403.340 to provide that when a parent or a de facto custodian is a member of the National Guard or Reserve and is deployed on federal active duty, any change in a child custody decree based in whole or in part on that deployment shall be temporary and shall revert back to the previous child custody decree at the end of the deployment; amend KRS 341.370 to prohibit unemployment insurance disqualification of a worker who leaves employment due to the military transfer of the worker's spouse to another state; require that the prohibition against unemployment insurance disqualification apply only when the worker and military spouse travel to a state with a similar prohibition; amend KRS 61.315 to require that the family of a member of the National Guard or Reserve killed on federal active duty shall receive a death benefit of $80,000; make this section apply retroactively to July 1, 2002; create a new section of KRS Chapter 40 to require the Kentucky Department of Veterans' Affairs to employ no fewer than five veterans' benefits regional administrators and no fewer than twenty veterans' benefits field representatives; EMERGENCY.

SB 2 - AMENDMENTS


     SCS - Retain provisions of the bill; require the Kentucky Department of Military Affairs to establish procedures to assist a person in acquiring professional and occupational credentials when that person moves to Kentucky due to the military transfer of that person's spouse; require state agencies to support the department's efforts; require that for a member of the National Guard or Reserve to qualify for a Kentucky Housing Corporation grant, that person must have family income equal to or less than 200 % of the state or area median income; require that when a child custody decree is modified due to the deployment outside the United States of a parent who is a regular member of the United States Armed Forces, the modification shall last only until the end of the deployment.

     SFA (1, J. Pendleton) - Attach the provisions of SB 33; amend KRS 186.020, regarding vehicle registration, to allow military personnel deployed outside the boundaries of the United States who have stored their cars on base during deployment to have 30 days from the date of their return to renew the vehicle's registration; further mandate that such vehicles not be subject to any delinquent fees, penalties, interest, or lien filing fees resulting from not paying the ad valorem taxes on the vehicle; specify that, if applicable, the clerk shall process the renewal on a prorated basis in accordance with KRS 186.051; amend KRS 134.148, regarding delinquent fees for motor vehicle ad valorem taxes, to conform.

     SFA (2, E. Tori) - Make technical correction to clarify that when a child custody decree is modified due to the military deployment of a parent, that modification shall last only until the end of the deployment, or at the discretion of the deployed parent, the modification may continue past the end of the deployment.

     HCS/FN - Retain provisions of the bill, except delete General Assembly appropriations as a source of money for the military family assistance trust fund; require that of the three members of the Military Family Assistance Trust Fund Board appointed by the Governor one shall be a military service retiree and one shall be the spouse of a military person on federal active duty or the spouse of a military service retiree; delete the requirement that the Department of Military Affairs establish a Mission: Welcome Home program; delete the requirement that the Department of Military Affairs establish a program to assist military spouses in obtaining professional and occupational credentials; require the Department of Military Affairs to publish information on its Web site to assist military spouses in obtaining professional and occupation credentials; require the Kentucky Housing Corporation to provide assistance to all members of the United States Armed Forces and not just members of the National Guard and Reserve on federal active duty; retain the prohibition against unemployment insurance disqualification of a worker who leaves employment due to the military transfer of the worker's spouse to another state but delete the requirement that the prohibition against unemployment insurance disqualification apply only when the worker travels to a state with a similar prohibition; delete the death benefit for a member of the National Guard or Reserve who dies on federal active duty; increase from 5 to 6 the minimum number of veterans' benefits regional administrators employed by the Kentucky Department of Veterans' Affairs; delete the grace period for renewing a motor vehicle registration that expires while the soldier owner is deployed outside the United States.
