HB 340/CI (BR 27) - R. Adkins, J. Bell, J. Crenshaw

     AN ACT relating to inmate recidivism reduction.
     Create new sections of KRS Chapter 197 relating to prisons, to permit the Department of Corrections to operate a Prison Industries Enhancement (PIE) program in which the labor of prisoners is leased to private entities to make products and provide services for private employers which shall be in compliance with federal law; create a commission to oversee the program; provide that the program is temporary and shall expire ten years after the first program begins reauthorized by the General Assembly.

HB 340 - AMENDMENTS


     HCS/CI - Retain most original provisions except, in Section 1 limit the provisions to being a pilot project in a facility that is designed to support prison industries and which can be expanded by 800 inmates, require a civilian worker being displaced to be performing the same task as a prisoner for an exclusion to apply, name the organization contracting with the state a "private sector partner"; in Section 2 relating to the Kentucky Prison Industry Enhancement Commission to limit the term of the House of Representatives member of the commission to two years or the remainder of the term of office whichever is shorter, limit the term of the Senate member of the commission to four years or the remainder of the term of office whichever is shorter, require that the Kentucky State AFL-CIO labor union rather than the commission recommend replacements for labor union members to the Governor, change the grievance process to require the first appeal to the commissioner, the next appeal to the Secretary of the Justice and Public Safety Cabinet, and the next appeal to the Franklin Circuit Court.
