HB 401 (BR 1513) - C. Rollins II, L. Belcher

     AN ACT relating to right-of-way permits.
     Create a new section of KRS Chapter 177 to provide that right-of-way permits authorized by the Department of Highways shall contain provisions allowing for the cessation of work, following a KRS Chapter 13B hearing, if the permit is not substantially complied with; require the Department of Highways to promulgate administrative regulations to implement the section.

     HCS - Retain original provisions except delete requirement that the opportunity for a KRS Chapter 13B hearing shall precede the cessation of work order; delete provision that an appeal of the final decision of the Department of Highways be made in Franklin Circuit Court.
