AN ACT relating to finance and administration, and declaring an emergency.
Create new sections of KRS Chapter 56 to describe the purposes of Sections 1 to 11 of the Act; to define terms used in Sections 1 to 11 of the Act; to create the Kentucky Asset/Liability Commission; to direct that OFMEA serve as staff to the commission; to define the powers and duties of the commission; to identify the nature of notes that may be issued; to provide for the designation of designees for commission members; to provide for the issuance of tax and revenue anticipation notes; to provide for the issuance of project notes; to provide for the issuance of funding notes; to provide that notes issued by the commission will be tax exempt; amend KRS 45A.840 to include the Kentucky Asset/Liability Commission within the definition of "bond issuing agency"; amend Section 45A.850 to establish procedures for selecting various advisors to the commission; amend KRS 27A.210 to change gender references; amend KRS 42.025 to revise procedures for the Division of Printing; amend KRS 45.101 to streamline expense procedures; amend KRS 45.251 to incorporate the information technology architecture; amend KRS 45.306 to apply to electronic commerce standards; amend KRS 45.310 to permit the keeping of records rather than books; amend KRS 45.313 regarding equipment inventory procedures; amend KRS 45.453 to include goods and services as a triggering event for payment; amend KRS 45.455 to include goods and services as a triggering event; amend KRS 45.456 to update references to the State Treasurer and to include payment documentation as the triggering event; amend KRS 45A.045 to include best value criteria and to allow the Finance and Administration Cabinet to dispose of personal property; amend KRS 45A.050 to conform; amend KRS 45A.070 to include the definition of "best value"; amend KRS 45A.080 to include best value criteria; amend KRS 45A.085 to remove reference to price as a criteria; amend KRS 45A.090 to incorporate best value criteria; amend KRS 45A.095 to incorporate best value criteria; amend KRS 45A.300 to conform; amend KRS 45A.660 to incorporate best value criteria; amend KRS 45A.695 to require the filing of one rather than three copies of a personal service contract with the LRC; amend KRS 45A.700 to increase the amount of personal service contract exempt from review by the subcommittee from $1,000 to $20,000; amend KRS 56.782 to conform; amend KRS 57.101 to delineate penalties for nondelivery; amend KRS 45A.605 to allow nonprofit schools and nonprofit health care organizations to have access to the information superhighway; amend KRS 42.500 to allow investment in additional classes of investments; amend KRS 42.525 to delete certain requirements for administrative regulations promulgated by the State Investment Commission; amend KRS 42.540, KRS 42.545, and KRS 42.550 to require reporting to the Office of the Controller rather than the State Investment Commission; amend KRS 42.410 and 56.782 to conform; repeal KRS 41.390, 42.515, 45A.710, 57.031, 57.041, 57.051, 57.061, 57.071, 57.081, 57.111, 57.121, 57.131, 57.141, and 57.280; EMERGENCY.
HB 5 - AMENDMENTS
HCS - Retain the provisions of the original bill; as they relate to access to the information highway, define the terms "nonprofit schools" and "nonprofit health care organizations" as those which have been granted tax-exempt status by the U.S. Internal Revenue Service Code.
HFA (1, D. Ford) - Require budget units to inventory equipment having an original cost of $500 or more, rather than to permit the Finance and Administration Cabinet to set the dollar amount by administrative regulation.
HFA (2, D. Ford) - Retain provisions of original bill; amend Section 16 to require receipts for any reimbursable expenses in excess of $10, and to allow the Finance and Administration Cabinet to promulgate an administrative regulation to increase the amount up to $25.
SCS - Retain the provisions of the G.A. version of the bill; add language that provides that the best value decision shall be based on criteria that have been communicated to the offerors in the invitation for bids; provide that United States denominated corporate, Yankee, and Eurodollar securities available for investment by the State Investment Commission exclude corporate stock; restore language that requires that funds available for investment be offered first to qualified Kentucky depositories.
SFA (1, D. Nunnelley) - Permit notice of disapproval or objection to personal service contracts to be transmitted from the Personal Service Contract Review Subcommittee to the secretary of the Finance and Administration Cabinet by electronic mail.
SFA (4, D. Williams) - Delete exemption for personal service contracts of $20,000.00 or under from review by the Personal Service Contract Review Subcommittee.
SFA (5, D. Williams) - Add the Auditor of Public Accounts as a member of the Kentucky Asset/Liability Commission, in lieu of the Attorney General; subject alternates to members of the Kentucky Asset/Liability Commission to the provisions of the Executive Branch Code of Ethics.
SFA (6, E. Tori) - Delete the authority to allow the Finance and Administration Cabinet to promulgate regulations to increase the level of reimbursement for a voucherless expense beyond the $10 maximum provided in the bill; delete reference to administrative regulations.
