HB 27/CI (BR 245) - M. Bowling, J. Gray
AN ACT relating to capital punishment and declaring an emergency.
Amend KRS 431.220, relating to execution of a death sentence, to allow the condemned, sentenced to death prior to the effective date of the Act, to choose between electrocution and lethal injection as the method of execution; require that lethal injection be the sole method of execution for all individuals sentence to death on or after the effective date of the Act; amend KRS 431.240 to grant the warden the discretion to determine when an execution shall take place on the day designated in the judgment of conviction, the governor's warrant, or an order of the court; amend KRS 431.250 to permit 3 members of the victim's family to attend the execution; create a new section of KRS Chapter 431 to require that if a court strikes down lethal injection as a method of execution, electrocution shall survive as a method of execution; create a new section of KRS Chapter 431 to apply the Act retroactively to prisoners sentenced to death prior to the effective date of the Act; EMERGENCY.
HB 27 - AMENDMENTS
HFA (1, C. Geveden) - Require that one media representative witness of capital punishment shall be from the daily or weekly newspaper with the largest circulation in the county where the offense occurred and one media representative witness shall be from the daily newspaper with the largest circulation in the county where the capital punishment will be conducted.
HFA (2, P. Marcotte) - Prohibit a physician or a nurse from participating in the execution of capital punishment, except for the pronouncement of death or to provide lifesaving medical care.
HFA (3, B. Heleringer) - End capital punishment and introduce the sentence of life imprisonment without the possibility of probation or parole.
HFA (4, C. Geveden) - Require that one media witness of capital punishment shall be from the daily newspaper with the largest circulation in the county where the execution will be conducted.
HFA (5, P. Marcotte) - Limit physician involvement in capital punishment to certifying cause of death, provided that the condemned is declared dead by another person.
