HB 285/FN/LM (BR 133) - J. Coleman
AN ACT relating to emergency medical services.
Create a new section of KRS Chapter 311 to permit paramedics with specialized training in determination of death to pronounce persons dead and call the coroner to the scene; create a new section of KRS Chapter 311 to permit paramedics, with proper equipment, to perform advanced life support to persons in emergency situations anywhere in the state; amend KRS 311.658 regarding rendering of services by paramedics to provide that the State Board of Medical Licensure determine in what prehospital settings services may be rendered; create a new section of KRS Chapter 216B to permit ambulance services to contract with or employ physician medical directors; create a new section of KRS Chapter 216B to permit ambulance services to provide liability insurance for physicians serving as medical directors; create a new section of KRS Chapter 216B to specify offenses during ambulance inspections, specify that certain supplies and equipment carried in medical care kits by emergency medical technicians and paramedics is considered to be on the ambulance for inspection purposes, and set penalties; create a new section of KRS Chapter 216B to set corrective actions for deficiencies of ambulance services and set penalties; amend KRS 216B.410 relating to ambulance run reports to permit electronic filing of information and to provide that state provide free master copy for making written reports; provide for authorized uses of ambulance run reports.
HB 285 - AMENDMENTS
HCS/FN/LM/CI - Delete provisions relating to expansion of practice of paramedics, insurance for medical directors of ambulance services, and hiring of medical directors of ambulance services; insert new provisions permitting registered nurses with proper training to pronounce death, and providing that complaints against nurses serving with an ambulance service be made to the Board of Nursing; retain provisions relating to complaints against physicians, paramedics with proper training pronouncing death, and emergency medical services data collection.
HFA (1, J. Coleman) - Provide that only a paramedic or nurse who has successfully completed required training may make a determination of death, provide that civil litigation is not compromised by sending complaints to the Board of Medical Licensure or the Board of Nursing.
HCA (1, M. Marzian) - Retain original provisions except clarify that the State Board of Nursing has sole jurisdiction regarding to complaints about nursing service in ambulance settings.
HFA (2, R. Damron) - Require paramedic or nurse to attempt to resuscitate patient who is resuscitatable prior to determining the patient to be dead.
