HB 3/FN (BR 85) - L. Clark
AN ACT relating to state financial administration.
Create a new section of KRS Chapter 45.750 to 45.810 to require a state agency, institution of higher education, or an affiliated corporation to obtain authorization from the General Assembly before entering into one of two types of agreements for the use, purchase, or acceptance of real property or equipment with a value in excess of $400,000; amend KRS 45.760 to prohibit the person charged with executing a branch budget from constructing a capital construction item in a manner which changes its purpose, size, location, or title and description as set forth in the branch budget bill, statutory budget memorandum, and other documents.
HB 3 - AMENDMENTS
HCS/FN - Retain original provisions of the bill, with the following changes: make a technical amendment to clarify that the bill's provisions are limited to public postsecondary education institutions and do not apply to private institutions; delete provision that would prevent an authorized project from expanding by more than 15% of the authorized square footage; permit change in configuration if the change is a practical accommodation of the program to be accommodated by the project.
SFA (1, T. Buford) - Limit the requirement that universities and their affiliated corporations have to obtain General Assembly authorization before entering into certain agreements to purchase real property or equipment to universities and affiliated corporations located in counties containing cities of the first class.
SFA (2, T. Buford) - Delete the requirement that the principal institution of higher education in Kentucky charged with conducting statewide research and service programs obtain General Assembly authorization before entering into certain agreements to purchase real property or equipment.
