HB 391 (BR 1644) - M. Long, R. Crimm

     AN ACT relating to architectural and engineering services and declaring an emergency.
     Create new sections of KRS Chapter 45A to permit the Finance and Administration Cabinet and the Transportation Cabinet to enter into price contracts for architectural and engineering services; establish procedures for qualifying to be selected for a price contract; permit the two cabinets to designate certain construction projects for which architects and engineers may be selected from a pool; establish procedures for qualifying and disqualifying architects and engineers for pools and ranking for selection those on a pool list; exempt price contracts and contracts awarded using selection from a pool from KRS 45A.800 to 45A.835, relating to selection of architectural and engineering services through selection committees; amend various sections of KRS 45A.800 to 45A.835 to add non-voting technical advisers who are Department for Facilities Management employees to architectural and engineering services selection committees; eliminate requirement for assigning Finance and Administration Cabinet engineers to architectural services selection committees, and cabinet architects to engineering services selection committees; specify that persons appointed to selection committees from nominations made by the Kentucky Society of Architects shall be architects and that those appointed from nominations made by the Kentucky Society of Professional Engineers and the Consulting Engineers Council shall be engineers; eliminate two-term limit on state employees serving in selection committee pools; increase from $100 to $200 the per diem pay of selection committee members who are not state agency or university employees.

HB 391 - AMENDMENTS


     HCS - Retain original provisions except add definitions of "engineering-related services" and "firm"; add provisions for procuring engineering-related services; utilize statutory selection committees for recommending firms to be awarded price contracts; require Transportation and Finance Administration Cabinets to promulgate administrative regulations governing pools; allow a firm removed from a pool to reapply to be qualified after one year of disqualification; make Auditor's staff's participation on selection committees discretionary with the Auditor; require Finance and Administration and Transportation Cabinets to submit statement of compliance with selection process to the Auditor upon completion of selection; require complete record of selection process to be subject to audit by the Auditor; EMERGENCY.
     HCA (1/Title, C. Geveden) - Make title amendment to declare emergency.
     SFA (1, D. Nunnelley) - Retain original provisions except remove the Finance and Administration Cabinet from the pool provisions; clarify that anyone performing "engineering related services" still must comply with any applicable licensing requirements; correct the name of the Kentucky Consulting Engineers Council.
     SFA (2, R. Roeding) - Require price contracts for engineering and architectural services to be reviewed by the Personal Service Contract Review Subcommittee.
