HB 4 (BR 45) - S. Nunn, R. Crimm, M. Marzian
      AN ACT relating to water pollution.
     	Create and amend sections of KRS Chapter 235 relating to boats and boating to define marine sanitation device; delete the authorization to the Natural Resources and Environmental Cabinet to allow the discharge of sewage from any vessel to the state's waters; delete the authorization to the cabinet to allow the use of treatment systems prior to disposing sewage from a vessel; prohibit keeping a motorboat equipped with marine toilet facilities on the waters of the state unless equipped with a marine sanitation device; require an applicant for a motorboat title and registration or registration renewal to state if the motorboat has toilet facilities; prohibit issuing a registration or registration renewal for a motorboat with toilet facilities until the applicant shows documentation that the marine sanitation device has passed inspection; require the cabinet to inspect marine sanitation devices every two years and to give documentation to the motorboat owner if the marine sanitation device passes the inspection; require the owner of a new motorboat with marine toilet facilities to request the cabinet to inspect the marine sanitation device; allow the documentation showing that a marine sanitation device has been inspected to satisfy these requirements when a new title and registration is applied for; require notice to the cabinet when the owner of a motorboat with marine toilet facilities is notified of the need to renew the boat's registration; require motorboats with marine toilet facilities to display a decal showing the marine sanitation device passed inspection; direct a boat marina owner to not allow a motorboat with marine toilet facilities to depart from the marina unless displaying the decal showing the marine sanitation device passed inspection; require boat marina owners to provide access to sewage pumpout facilities by July 15, 2000; authorize officials of the Department of Fish and Wildlife to enter boat marinas to inspect for the availability of sewage pumpout facilities and to enter upon boats to inspect marine sanitation devices; authorize the cabinet to promulgate regulations to carry out its responsibilities; repeal KRS 235.450, 235.460, and 235.470; delay effective date until July 15, 2000.
 
HB 4 - AMENDMENTS 
      HCS - Retain original provisions; define "federally regulated commercial vessel"; revise definition of "marine sanitation device"; exclude federally regulated commercial vessels from definition of motorboat; allow a marina owner to contract for pumpout services with a marina within eight miles, rather than four miles; allow the Department for Fish and Wildlife Resources to enter into agreements with qualified parties to accept inspections of marine sanitation devices; allow the penalty for failure to install pumpout stations to be assessed each day the violation continues; repeal KRS 235.480.
      HFA (1, B. Yonts) - Provide for higher penalties for repeated marine sanitation violations by boat operators.
      HFA (2, K. Hogancamp) - Require a marina owner or employee to grant permission for inspections of marina pumpout facilities by Department of Fish and Wildlife officials; require inspections to be made during a marina's normal business hours.
      SCA (1, R. Leeper) - Allow landspreading of septic tank sewage at approved sites.
