AN ACT relating to the construction industry.
Create new sections of KRS Chapter 198B to establish a contractor certification program to be administered by the Department of Housing, Buildings and Construction; establish an advisory board, the Kentucky Advisory Council on Contractor Certification, to advise the commissioner and approve fees established for certification; create a uniform definition for enforcement purposes of "independent contractor"; amend 198B.060 to delete the requirement that a person must assure, by affidavit, that he or she has complied with workers' compensation and unemployment insurance laws, and substitute the showing of a current contractor certification or membership card in a builders' association as proof of coverage; increase the fine for noncompliance and add injunctive relief as a remedy.
