HB 495 (BR 2004) - J. Gooch

     AN ACT relating to fiscal courts regulating traffic on county roads.
     Amend KRS 189.230, relating to the reduction of loads and speed limits, to provide for the fiscal court, not the county judge, to have authority to reduce loads and speed limits on county roads; allow city governments to lower loads and speed limits on city streets; create a new provision to allow cities and counties to authorize overweight and overdimensional vehicles on roads under their jurisdiction as long as the vehicle does not exceed 80,000 pounds; create a new section of KRS Chapter 189, relating to traffic regulations, to define the term "materials"; establish a procedure for local governments to issue overweight and overdimensional permits; amend KRS 189.221, relating to basic weight and dimension limits for highways, to conform; amend KRS 189.990, relating to penalties governing traffic regulations, to provide for a penalty for a person operating a motor vehicle in violation of a local government permit for overweight or overdimensional vehicles.

HB 495 - AMENDMENTS


     HCA (1, H. Collins) - Retain the provisions of the original bill, with the following changes: remove city governments from the provisions of the bill; delete all references to local governments and insert in lieu thereof fiscal court; add a provision to prohibit a fiscal court from receiving rural and secondary road aid money on any route on which the court raises weight limits under the provisions of the bill; amend KRS 177.360 to conform.
     HFA (1, J. Gooch) - Retain the provisions of the original bill with the following changes: remove city governments from the provisions of the bill; delete all references to local governments and insert in lieu thereof fiscal court; delete subsection (4) of Section 1 in its entirety and insert in lieu thereof a provision to require a person applying for a permit under Section 2 of the bill to enter into a cooperative agreement with the fiscal court; require the agreement to provide for an equitable apportionment of the incremental costs for damage done to a county road while operating under a permit; provide for a person's permit to be immediately revoked if the person terminates the cooperative agreement with the fiscal court.
     HFA (2, J. Gooch) - Make title amendment.
     SCS/LM - Retain original provisions; except require fiscal courts to comply with the maximum weight limits established by KRS 189.222.
