HB 583/FN (BR 1594) - C. Hoffman, S. Johns, E. Jordan, T. McKee

     AN ACT relating to child care facility licensure.
     Amend KRS 199.640 and KRS 199.896 to prohibit employment of persons convicted of any sexual offense; permit public information regarding inspections of day care centers and licensure denial, suspension, or violation; amend KRS 199.898 to add parents' rights to obtain information regarding inspections, licensure denial, suspension, or violation and identifying information about children and families to remain confidential; amend KRS 199.8982 to require cabinet to promulgate administrative regulations for release of information.

HB 583 - AMENDMENTS


     HCS/FN - Retain original provisions, except restrict Cabinet's responsibility to disclose information about inspections to those occurring within the past year and permit parents and other interested persons, upon request, to obtain information as to whether the operator of a day-care center or a family child-care provider has had any type of day care license denied, suspended, revoked, or has committed a violation; place responsibility for disclosure for other years, up to five years, on center and the family child-care home; set out in the parent's, custodian's, or guardian's bill of right the right to obtain information from the Cabinet about the center's, home's. program's or provider's inspections and plans of correction; require that the director of a child care center not have a history of abusing or neglecting children; prohibit any child care provider from employing person found guilty of a sexual offense.
     SCA (1, E. Rose) - Retain original provisions except delete requirement that persons must have a legitimate interest in order to obtain public information regarding licensure denial, suspension, revocation or violations.
     SFA (2, D. Kelly) - Retain original provisions except that a director of child day care shall not be found by a court, rather than the cabinet or a court, to have abused or neglected a child.
