HB 616 (BR 1790) - G. Lindsay
AN ACT relating to secondary area vocational education and technology centers.
Create a new section of KRS Chapter 151B establish an option for a local board of education to assume the management and control of a state-operated secondary vocational education and technology center with approval of the State Board for Adult and Technical Education if certain conditions are met, including that the local board of education agree to continue the programs and retain the teachers, administrators, and all other certified and classified staff for one (1) complete school year following the initial transfer; provide that in subsequent years, all decisions relating to programs, curriculum, and staff shall be under the local board authority; provide for the transfer of funds that are used by the Cabinet for Workforce Development to the local board of education; provide that the affected employees receive compensation for their accrued annual leave and comp time and that they be able to transfer sick leave based on the local board policy and as provided in KRS 161.55(3); provide that any certified staff person with continuing status under KRS Chapter 151B may be granted tenure in the local school district as described in KRS 161.765; amend KRS 161.740 to conform.
HB 616 - AMENDMENTS
HCS - Retain the original provisions, except delete the requirement that a district serving students only from one district may request a transfer; provide that a local district serving multiple districts may request a transfer but require the local district to continue to serve students from all districts currently using the center at the time of transfer and that the curriculum shall be based on needs of the students in the local area based on a needs assessment; clarify the funds that will be provided to support any transfer of a center; provide that funds transferred may only be used for vocational purposes and not for any other use in the district; provide that all transferred employees shall be granted contracts of at least one year; provide that employees with continuing status in a certified position in the KRS 151B system shall be provided tenure without serving a one year probationary period in the local school district; provide that an employee who does not accept a local contract shall be able to apply for any state position for which the employee is qualified and the employee shall be given priority over other candidates; require the Kentucky Department of Education to determine if equitable funding is provided to supplement the local operation of current centers and propose recommendations by July 15, 1999; EMERGENCY.
HFA (1, M. Long) - Amend KRS 164.020 to extend the waiver of tuition for college credit coursework to employees of secondary area vocational education centers.
