HB 617/FN (BR 1828) - J. Lee, B. Colter, E. Jordan
AN ACT relating to the regulation of entities that provide child care or child placement services.
Amend KRS 199.011 to include state operated facilities in the definition of child-caring facility; amend KRS 199.640 to establish guidelines for the promulgation of regulations relating to the licensing of child-placing and child-caring agencies; amend KRS 199.670 to establish an informal dispute resolution process for deficiencies contested by child-placing or child-caring agencies; establish areas of jurisdiction if the Cabinet for Human Resources reorganization is confirmed by the General Assembly.
HB 617 - AMENDMENTS
HCA (1, J. Lee) - Amend the definition of "child caring facility" to except residential programs operated by or contracted by the Department of Juvenile Justice which maintain accreditation from a nationally recognized accrediting organization.
SCA (1/FN, D. Seum) - Retain original provisions except add that no Medicaid reimbursement is permitted for out-of-state behavioral residential care, unless no in-state provider is willing or available to provide services at a comparable rate; permit exception at request of parent; require cabinet to promulgate administrative regulations.
SFA (2, D. Seum) - Retain original provisions except add new section to amend KRS 199 and KRS 205.634 to prohibit reimbursement to out-of-state providers of children's residential care for children from Medicaid funds or Department for Social Services funds unless both cabinets determine there is no in-state provider available at a comparable cost; allow exceptions based on type of services needed and geographical location of services; require both cabinets to establish uniform conditions, requirements, and exceptions and include such in administrative regulations.
