AN ACT relating to the legal process for the custody, care, and treatment of persons suffering from serious mental illness who are charged with or have been convicted of violent crimes.
Create new sections of KRS Chapter 504 to create a psychiatric review board to review proper disposition of persons who have been found incompetent to stand trial, or who have been tried and found not guilty by reason of insanity, or who have been paroled and then suffered recurring mental illness, or who continue to manifest serious mental illness prior to release from prison; provide various mental health commitment proceedings to confine or otherwise treat such persons until mental health is restored; amend KRS 504.030, 504.110, and 504.120; relating to guilty but mentally ill verdicts, to conform; amend KRS 202A.026, relating to hospitalization of the mentally ill, to conform; repeal various sections of KRS Chapter 504 relating to guilty but mentally ill verdicts.
