AN ACT relating to the Kentucky Unified Juvenile Code.
     Amend KRS 635.080, relating to who is tried as a public offender and who is tried as a youthful offender, to set forth the grounds for trial as a youthful offender; create a new section of KRS Chapter 635 to provide that no child over 17 shall be detained in a juvenile detention facility and that at age 18 the person shall be transferred to an adult detention facility; amend KRS 640.010, relating to the court decision to try a person as a youthful offender, to change the court "finds" to the court "is of the opinion"; amend KRS 640.020, relating to the grounds for transfer and trial as a youthful offender, to correspond with those in KRS 635.080; amend KRS 640.020, relating to place of detention of person proceeded against as a youthful offender, to make technical change; amend KRS 640.030, relating to sentencing of youthful offenders, to provide that when the youthful offender becomes 18 the offender is returned to the sentencing Circuit Court to be placed on probation or incarcerated in an institution operated by the Department of Corrections; amend KRS 640.040, relating to sentencing of youthful offenders to remove restriction on parole or conditional discharge; amend KRS 640.070, relating to transfer of youthful offenders to Department of Corrections, to include violence against another resident of a youth facility; amend KRS 40.100 and 640.110, relating to juvenile records, to include the Department of Juvenile Justice; amend KRS 610.320, relating to juvenile records, to provide that the juvenile court make all juvenile records available to the Circuit Court when the Circuit Court is making bail decisions for a person charged as a youthful offender.
